Temporary Spousal Support (Pendente Lite)

While your case is pending, the Court may award temporary spousal support using a California guideline formula. This support—called pendente lite—is designed to help maintain the standard of living during the separation process.

Key factors the court may consider include:

  • Income of each party

  • Income-to-debt ratio

  • Voluntary underemployment or unemployment

  • Available assets

  • Relevant Family Code Section 4320 factors

The court generally sticks to the guideline formula but can make adjustments based on your circumstances. The goal is to provide temporary financial continuity as one household becomes two.

 

Permanent/Post-Judgment Spousal Support

Determined by Legal Factors—Not a Formula

When a divorce is finalized, temporary formulas are no longer used. Instead, the court considers a broader set of legal factors outlined in Family Code Section 4320, including:

  • Length of the marriage

  • Each spouse’s employment history and earning capacity

  • Tax implications of support

  • Contributions to the household or other spouse’s success

  • Age and health of each spouse

  • Marital standard of living and ability to maintain it

The objective of post-judgment spousal support is to provide fair financial footing as both parties move into the next chapter of life. In some cases, this support is negotiated through agreement; in others, it is determined through litigation.

 

How Long Does Spousal Support Last?

It Depends on the Length of the Marriage—and Other Factors

  • For marriages under 10 years: Support is typically awarded for half the duration of the marriage.

  • For marriages over 10 years: There is no automatic end date—the court has discretion based on the case details.

However, length of marriage alone does not guarantee support, and outcomes can vary depending on your unique situation. We can help you build a case that supports your goals—whether seeking support or contesting it.
